    LD 1303 - RESOLUTION, Proposing an Amendment to the Constitution of Maine to Establish the Right to Hunt and Fish. This bill is having its Public Hearing in front of the Inland Fisheries and Wildlife Committee on Tuesday, April 30 at 1pm. Link to bill summary

    The Sportsman's Alliance of Maine helped draft this legislation and we encourage our SAM members to contact the IFW Committee members to urge their support on LD 1303.

    The passage of this bill will help to secure our future in our long-standing outdoor sporting heritage.

    I suspect it will pass since the wordage is politically correct and it has alot of sponsers....Keeping fingers crossed......From what I gather it protects our right to always hunt and fish but......what,when,where,why is always the primary problem....The laws to continue to do something can always be challanged in other ways.....For instence; you can still hunt but this way only,on this day only,between this time only,ect......But it's still protection dont get me wrong......We'll take whatever we can get.....SAM done a great job helping draft this bill and the seemed to hit the nail on the head when it was written.....Hopefully it sends a message that our state has a backbone and wont put up with all the BOGUS groups wanting us all to eat grass......

    Here's a copy of the wording.....included is the word harvest, so I'd say yes as far as the law goes......Looks like it's going to referendum......

    Constitutional amendment. Resolved: Two 1 thirds of each branch of the
    2 Legislature concurring, that the following amendment to the Constitution of Maine be
    3 proposed:
    4 Constitution, Art. IX, §26 is enacted to read:
    5 Section 26. Personal right to hunt, fish and harvest wildlife; limitations.
    6 The freedom to hunt, fish and harvest wildlife traditionally taken by hunters and anglers
    7 is a valued natural heritage that must be forever preserved for the citizens of this State.
    8 Every citizen has the personal right to hunt, fish and harvest wildlife, using traditional
    9 methods, subject only to statutes enacted by the Legislature and to rules adopted by the
    10 designated state agency to promote wildlife conservation and management and to
    11 preserve the future of hunting and fishing. Public hunting and fishing are a preferred
    12 means of managing and controlling wildlife. This section may not be construed to
    13 modify any provision of law relating to trespass, property rights or the regulation of
    14 commercial activities.
    15 ; and be it further
    16 Constitutional referendum procedure; form of question; effective date.
    17 Resolved: That the municipal officers of this State shall notify the inhabitants of their
    18 respective cities, towns and plantations to meet, in the manner prescribed by law for
    19 holding a statewide election, at a statewide election held in the month of November
    20 following the passage of this resolution, to vote upon the ratification of the amendment
    21 proposed in this resolution by voting upon the following question:
    22 "Do you favor amending the Constitution of Maine to provide that the
    23 citizens of Maine have the personal right to hunt, fish and harvest
    24 wildlife, subject to laws and rules that promote wildlife conservation and
    25 preserve the future of hunting and fishing, and to provide that public
    26 hunting and fishing are a preferred means of managing and controlling
    27 wildlife?"
    28 The legal voters of each city, town and plantation shall vote by ballot on this question
    29 and designate their choice by a cross or check mark placed within the corresponding
    30 square below the word "Yes" or "No." The ballots must be received, sorted, counted and
    31 declared in open ward, town and plantation meetings and returns made to the Secretary of
    32 State in the same manner as votes for members of the Legislature. The Governor shall
    33 review the returns. If it appears that a majority of the legal votes are cast in favor of the
    34 amendment, the Governor shall proclaim that fact without delay and the amendment
    35 becomes part of the Constitution of Maine on the date of the proclamation; and be it
    36 further
    37 Secretary of State shall prepare ballots. Resolved: That the Secretary of State
    38 shall prepare and furnish to each city, town and plantation all ballots, returns and copies
    39 of this resolution necessary to carry out the purposes of this referendum.
